Terms of Service

These Terms of Service govern your access to and use of the Beehive Health website, patient-facing technology, customer support, and related non-clinical services. By using the services or accepting these Terms during checkout, you agree to them.

Who provides the services

These Terms are an agreement between you and Beehive Health LLC (“Beehive,” “we,” “our,” or “us”) for the non-clinical services described here.

Medical services are provided by Wasef Health and its affiliated professional entities, including Wasef Health of CA, P.C. (CA), Wasef Health of KS, P.A. (KS), Wasef Health of TX, P.A. (TX), and Wasef Health, P.C. (NJ) (collectively, “Wasef Health” or the “Medical Group”), and their licensed clinicians. The professional entity responsible for your care depends on your location and applicable law and will be identified in connection with your care.

Beehive provides technology, administrative, payment, customer-support, and care-coordination services. Beehive does not diagnose conditions, prescribe medication, or direct clinical judgment. Pharmacies and other health care providers are responsible for their own services.

Eligibility and availability

You must be legally capable of agreeing to these Terms and must use the services only for yourself unless an authorized-representative process is expressly offered. Services may be available in all 50 states, but a particular service, clinician, pharmacy, or product may not be available everywhere. Availability depends on your location, clinician licensure, clinical eligibility, pharmacy coverage, product supply, and applicable law.

We may require identity, age, location, contact, payment, or other verification before you use a feature or receive a service.

Not for emergencies

The services are not an emergency service and are not designed for urgent or life-threatening conditions. If you believe you may have a medical emergency, call 911 or go to the nearest emergency department. Do not wait for a response through the services.

Your information and account

You agree to provide accurate, current, and complete information. Clinical decisions may depend on what you provide, so you must answer health questions truthfully and update relevant information when it changes. Keep your credentials confidential and contact care@beehivehealth.com promptly if you suspect unauthorized access.

You may not impersonate another person, seek medication for another person, submit information you know is false, interfere with security, introduce malicious code, scrape restricted portions of the services, or use the services unlawfully.

Clinical review, prescriptions, and fulfillment

Completing an intake, requesting a product, or making a payment does not guarantee treatment or a prescription. A licensed clinician will independently decide whether treatment is appropriate and may request more information, recommend another option, decline treatment, discontinue treatment, or refer you to in-person or emergency care.

If a prescription is issued, a dispensing pharmacy makes its own dispensing decision and may request additional information. Follow the instructions supplied by your clinician and pharmacy. Do not change a dose, combine treatments, share medication, or use a prescription other than as directed.

Prices, payment, and renewals

The price, included services, total amount charged, and billing cadence presented at checkout apply to your purchase. If you select a recurring plan, it renews at the interval disclosed at checkout until canceled under the cancellation terms shown before purchase. You authorize the identified merchant and its payment processor to charge the amounts you affirmatively accept.

Keep your payment information current. A failed payment may delay or suspend non-emergency services or fulfillment. We may correct an obvious pricing or billing error and will provide any notice, choice, credit, or refund required by law.

Cancellations and refunds

Contact care@beehivehealth.com as soon as possible to request cancellation. A cancellation request does not override a clinician's medical judgment and may be impossible to complete after clinical, pharmacy, or shipping work has begun.

To the fullest extent permitted by law, fees for services already performed and amounts attributable to a patient-specific prescription product for which preparation, compounding, dispensing, or fulfillment has begun are final and nonrefundable. Prescription medication cannot be returned, restocked, or resold after fulfillment begins or shipment occurs.

This restriction does not eliminate a remedy required by law for a duplicate or unauthorized charge; an incorrect, damaged, contaminated, tampered, or mislabeled product; a verified lost or undelivered shipment; a quality issue; or a paid product or service the responsible party does not provide. If treatment is not prescribed, any unearned medication, pharmacy, fulfillment, or shipping amount will be handled under the terms shown at checkout and applicable law. A separately disclosed fee for clinical review already performed may remain nonrefundable where permitted.

Canceling a recurring plan stops future renewals after the disclosed cutoff but does not automatically reverse a charge already processed or work already performed. Product-specific checkout terms control when they provide more detail and do not waive a non-waivable legal right.

Compounded medications

Some products offered through the services may be compounded. Compounded drugs are not FDA-approved, and the FDA does not review them for safety, effectiveness, or quality before marketing. A licensed clinician decides whether a compounded medication is appropriate for an individual patient. A compounded drug is not the same as an FDA-approved generic drug.

Communications and privacy

You agree that agreements, notices, receipts, disclosures, and other records may be delivered electronically. We may send operational communications concerning an account, care request, payment, safety issue, prescription, order, or shipment. Promotional communications will include the choices required by law.

How Beehive collects and uses personal information is described in our Privacy Policy. Medical records and information maintained by the Medical Group, a pharmacy, or another provider may be governed by that provider's privacy notice.

Ownership and third-party services

The services, excluding information you submit and third-party material, are owned by Beehive or its licensors. We grant you a limited, personal, revocable, non-exclusive, non-transferable right to use them for their intended purpose.

The services may connect to the Medical Group, pharmacies, carriers, payment processors, and other third parties. Their services may be governed by separate terms and privacy notices. Nothing in these Terms excuses Beehive or another party from responsibility the law imposes for its own conduct.

Service disclaimers

To the maximum extent permitted by law, Beehive's non-clinical services are provided on an “as available” basis. We do not promise uninterrupted or error-free access, a particular medical outcome, the availability of a particular clinician, pharmacy, medication, product, future price, or delivery date. Some jurisdictions do not permit certain exclusions, so an exclusion applies only to the extent the law permits.

Limitation of liability

To the maximum extent permitted by law, Beehive will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from its non-clinical services. Beehive's aggregate liability for a claim concerning its non-clinical services will not exceed the greater of $500 or the non-clinical fees you paid to Beehive during the 12 months before the event giving rise to the claim.

This section does not limit liability that cannot lawfully be limited, including liability for fraud, gross negligence, willful misconduct, personal injury or death where such a limitation is prohibited, or a health care provider's professional responsibility for its own clinical services.

Disputes and governing law

Before filing a dispute concerning Beehive's non-clinical services, please send a written description of the issue and requested resolution to care@beehivehealth.com. The parties will attempt in good faith to resolve the matter informally for 30 days.

Except where non-waivable law requires otherwise, these Terms and disputes concerning Beehive's non-clinical services are governed by Colorado law, without regard to conflict-of-law rules. Any court proceeding must be brought in the state courts located in Denver County, Colorado, or the United States District Court for the District of Colorado.

This section applies to Beehive's non-clinical services. It does not alter the law, forum, professional standard of care, informed-consent terms, or other rules that apply to a claim concerning clinical services provided by Wasef Health, a clinician, pharmacy, or another health care provider.

Changes and general terms

We may update these Terms as our services or legal obligations change. Revised Terms will be posted with a new effective date, and we will provide additional notice or request renewed acceptance when required. Changes do not retroactively alter an accepted charge or materially reduce a right without the notice or consent required by law.

If a provision is unenforceable, it will be modified or severed only to the minimum extent necessary, and the remaining provisions will continue in effect. A delay in enforcing a provision is not a waiver.
